I have been reading about the decision against North Sails regarding 3DL-Sobstad patent infringements. I realize that many J/30 owners use 3DL for the class #1. I also realise that some owners may now be without the 3DL sails they ordered...

Here's the scoop - I have a BRAND NEW, North 3DL class genoa (mylar/pentax) that was used in two light air races (under 6 knots) at the 1999 Youngstown levels. I bought the sail from the North Sails Toronto loft after an individual in Buffalo refused to pay for the sail due to an extremely lengthy construction/delivery period. I do not race one-design and incur a PHRF penalty for using the sail.

I am interested in selling the sail since I will only use it for Youngstown and would rather use the proceeds from my 3DL sail for a panelled 155% genoa. I am asking US$2,250 dollars. Again, I will restate that the sail is in extreme pristine, factory fresh condition... my sail numbers have been on the sail less than 9 months.

Interesting. Where have you been reading about North/Sobstad? I have a 3DL genoa and it has been a very good sail. North was trying to get people to try it at the time and discounted it to lower than a panelled sail.

I believe 3DL sails ordered before April 1 can still be built and delivered. I think North is seeking a restraining order on the injunction (hope I've got the terms correct) until appeals can be heard. Who knows how long that will take.

I think Dennis has it partly right. My understanding is that the sails already under construction may be completed, but no new sails can be started.

It is also my understanding that North is not allowed to perform any repairs also. Is this correct or not.

Just found my own answer on the Sailing World Web page the judges ruling has been overturned North continues to make 3DL The story goes on.

My understanding is that the ruling stands, but that the injunction on production of current orders has been lifted pending any appeals. North still has lost its case.
